UVINNECO was developed and manufactured by J in P d.o.o. AquaVeya d.o.o. sells the product in its own name and for its own account. The contract of sale is concluded between the buyer and AquaVeya d.o.o., which is responsible for fulfilling the order and for any lack of conformity of the goods.
Validity and application of the terms
These general terms and conditions govern the use of the UVINNECO online store, the placing of orders, payments, delivery, withdrawal from the contract, returns, lack of conformity of goods, warranty and dispute resolution. The buyer is made aware of the valid version of the terms before placing an order and may save or print them.
Provisions relating to special consumer rights apply to natural persons who purchase goods for purposes outside their professional or business activity. Companies and other legal entities may likewise make purchases; consumer rights apply to them only where this is expressly provided by law or by these terms.
Products and information
AquaVeya endeavours to present product descriptions, photographs, technical information, compatibility and other properties accurately and comprehensibly. Minor deviations in appearance that do not affect the functionality of the product may result from screen display, production batch or photography.
Before purchase, the buyer is obliged to check whether, according to the published information, the product is suitable for their tap and intended manner of use. If the buyer needs assistance with compatibility, they may contact support@uvinneco.com before ordering.
Prices, taxes and promotions
All prices in the online store are stated in EUR and represent the final price for the buyer. Taxes are charged or included in accordance with the applicable tax legislation and the tax status of the seller at the time of purchase.
At the start of online sales, standard delivery to European Union countries is free of charge. AquaVeya may change the delivery terms or introduce a delivery charge in the future; for each individual order, the price and terms displayed before the order is placed always apply.
Discounts, promotional prices and quantity discounts apply under the conditions of the individual promotion. Unless expressly stated otherwise, discounts are not cumulative. Any automatic discount on the purchase of two products is displayed in the cart or before the order is confirmed.
Placing an order and conclusion of the contract
The buyer selects the product, the quantity and a suitable payment method, and checks the delivery and invoicing details before placing the order. After placing the order, the buyer receives an electronic acknowledgement of receipt or confirmation of the order.
The sales contract is concluded when AquaVeya confirms the order. If the order cannot be fulfilled due to exceptional circumstances (for example, an obvious technical error in the price, lack of stock or an unsuccessful payment), AquaVeya shall notify the buyer thereof and refund any payment already received without undue delay.
Payment methods
Payments are processed via Shopify Payments and other enabled payment service providers. Depending on the buyer's country, device and availability, the following may be available:
- Visa
- Mastercard
- American Express
- Apple Pay
- Google Pay
- Shop Pay
- Klarna
- PayPal
An individual payment method may be subject to additional terms of the payment service provider. AquaVeya does not receive full payment card details where these are processed directly by the payment service provider.
Cash on delivery and direct bank transfer are not standard options in the online checkout at the start of sales. Any payment against a proforma invoice may be arranged individually via support@uvinneco.com.
Invoice
The buyer receives the invoice in electronic form at the e-mail address stated with the order. Before placing the order, the buyer must check that the invoicing details are correct. When purchasing for a company, the company name, address and tax or VAT number must be entered, where relevant and enabled in the checkout.
No later than upon delivery of the goods, the consumer is also provided, on a durable medium (e.g. by e-mail or as an e-mail attachment), with confirmation of the concluded contract containing the legally required information, including the conditions of withdrawal and the withdrawal form. A mere link to a changeable web page is not considered a durable medium.
Delivery
At the start of sales, AquaVeya delivers to addresses in European Union countries. Shipments are dispatched from Ljubljana, Slovenia, as a rule via Pošta Slovenije.
Orders successfully placed and paid on a working day by 15.00 are as a rule dispatched on the same working day. Orders placed after 15.00 are as a rule dispatched on the next working day. Saturdays, Sundays and public holidays are not counted as working days.
The estimated delivery time within the European Union is 3–7 working days from dispatch. This deadline is indicative and may be extended due to circumstances at the carrier, public holidays, higher workload or other circumstances over which AquaVeya has no direct influence. The buyer as a rule receives shipment tracking details by e-mail.
The risk of loss of or damage to the goods passes to the consumer when the consumer, or a third party designated by the consumer and other than the carrier, physically takes possession of the goods.
The consumer's right of withdrawal from the contract
In the case of a contract concluded at a distance, the consumer may withdraw from the contract without giving a reason within 14 days from the day on which they acquire physical possession of the goods.
To exercise the right of withdrawal, the consumer must notify AquaVeya before the expiry of the deadline by an unequivocal statement to support@uvinneco.com or by using the model form appended at the end of these terms.
After notifying the withdrawal, the consumer must send the goods without undue delay and no later than within 14 days to: AquaVeya d.o.o., Vodovodna cesta 65, 1000 Ljubljana, Slovenia.
The direct costs of returning the goods in the case of an ordinary withdrawal from the contract are borne by the consumer. If the goods were delivered incorrectly, damaged upon delivery or not in conformity, the justified return costs are borne by AquaVeya.
The goods must be returned with all parts and accessories received. The consumer is liable for any diminished value of the goods where the diminished value results from handling of the goods other than what was necessary to establish their nature, characteristics and functioning. The mere use of the goods to the extent necessary for such an inspection does not deprive the consumer of the right of withdrawal.
Refund of payments after withdrawal
In the event of a valid withdrawal, AquaVeya shall refund the payments received without undue delay and no later than within 14 days of receiving the notice of withdrawal. The refund may be withheld until the returned goods are received or until proof is provided that the goods have been sent back, whichever occurs first.
The refund is as a rule made using the same means of payment as was used in the original transaction, unless expressly agreed otherwise with the consumer.
Lack of conformity of goods and complaints
As the seller, AquaVeya is liable for any lack of conformity of the goods in accordance with the applicable consumer legislation. In consumer purchases, the seller is liable for any lack of conformity which exists at the time of delivery and becomes apparent within two years of the delivery of the goods.
The consumer may notify AquaVeya of a lack of conformity at support@uvinneco.com. The consumer must describe the lack of conformity precisely and notify the seller thereof within two months from the day on which it was established. It is recommended to state the order number and, where possible, to attach photographs or video where this facilitates the handling of the claim. The consumer must allow the seller to inspect the goods.
In the event of a lack of conformity, the consumer has the rights provided by the applicable legislation, in particular the free bringing of the goods into conformity by repair or replacement and, where the statutory conditions are met, a proportionate price reduction or withdrawal from the contract. Bringing the goods into conformity shall be carried out within a reasonable period which as a rule may not exceed 30 days; under the statutory conditions this period may be extended by a maximum of 15 days, of which the consumer is notified in good time. If the existence of the lack of conformity is disputed, AquaVeya shall notify the consumer thereof in writing within eight days of receiving the claim.
UVINNECO 2-year voluntary (commercial) warranty
AquaVeya d.o.o. provides a 2-year voluntary (commercial) warranty for the main UVINNECO device, which begins to run on the day the product is delivered to the consumer. The warranty is an additional right and does not limit the consumer's statutory rights arising from a lack of conformity of the goods.
The warranty covers defects in material, workmanship and the mechanical or electronic functioning of the device under normal and proper use in accordance with the instructions. The Kinetic Reactor is a consumable cartridge and is not covered by the 2-year voluntary warranty with regard to normal wear or the expiry of its expected service life. This does not affect any statutory rights arising from a lack of conformity of the Kinetic Reactor cartridge that existed at the time of delivery.
The warranty does not cover damage arising from improper installation or use contrary to the instructions, mechanical damage, impacts, improper interference with the device, unauthorised repairs or modifications, normal wear or use outside the conditions laid down in the instructions for use.
The detailed conditions and the procedure for making a claim are set out in the warranty certificate, which is handed over to the consumer no later than upon delivery of the product.
Complaints and customer support
The buyer may send questions, claims and complaints to support@uvinneco.com. AquaVeya endeavours to resolve disputes quickly, transparently and amicably, without any advance promise of a specific response time.
Privacy and cookies
The processing of personal data is described in more detail in the Privacy Policy. The use of cookies and other tracking technologies is described in the Cookie Policy. Both policies are available at www.uvinneco.com.
Out-of-court resolution of consumer disputes (IRPS)
AquaVeya d.o.o. does not recognise any provider of out-of-court resolution of consumer disputes as competent to resolve a consumer dispute that the consumer could initiate under the Zakon o izvensodnem reševanju potrošniških sporov (Slovenian Out-of-Court Resolution of Consumer Disputes Act), except where participation is required by applicable legislation.
If AquaVeya rejects the consumer's complaint, it shall inform the consumer in its reply of the information required by the applicable legislation on the out-of-court resolution of consumer disputes.
Governing law and dispute resolution
These relationships are governed by the law of the Republic of Slovenia; however, the choice of Slovenian law does not deprive a consumer who has their habitual residence in another country of the mandatory protection afforded to them by the mandatory provisions of the law of the country of their habitual residence, where those provisions apply.
The parties shall first attempt to resolve any disputes amicably. If this is not possible, jurisdiction shall be determined in accordance with the applicable regulations.
Changes to the terms
AquaVeya may amend these terms due to changes in its business, the functionality of the store or legislation. The terms available to the buyer at the time the order is placed apply to each individual order. The effective date is stated at the top of the document.
